By accessing or using TixTreasure (the "Service"), operated by Pops Technologies, LLC (the "Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
We may update these Terms at any time. Continued use after changes constitutes acceptance. We will post the revised "Last Updated" date at the top of this page.
TixTreasure is a ticket price comparison and aggregation platform. We aggregate publicly available ticket listing data from third-party resale marketplaces and display it in a unified interface to help users compare prices for live events.
Important: TixTreasure does not sell tickets, process payments, issue refunds, negotiate terms, or participate in any transaction between you and any ticket provider. All ticket purchases are completed directly on third-party platforms. TixTreasure does not endorse, guarantee, or warrant any ticket, seller, event, venue, or third-party marketplace.
TixTreasure participates in affiliate marketing programs with ticket resale platforms. When you click on links to purchase tickets through the Service, we may receive compensation from affiliate partners.
While we make reasonable efforts to display accurate and current pricing information, ticket prices and availability change constantly. We do not guarantee that:
Always verify the final price and event details on the third-party marketplace before completing your purchase.
Our price alert feature notifies you by email when tickets matching your criteria become available. Alert matching depends on data from third-party sources and may not capture every available ticket. We do not guarantee that alerts will be delivered in real-time, that every matching ticket will trigger an alert, or that prices will still be available when you receive the notification.
The Service uses browser fingerprinting technology (ThumbmarkJS) to create an anonymous identifier for your session. This allows us to provide personalized features such as saved preferences, watched events, and price alerts without requiring account registration. All content, features, and functionality of the Service (including seatmap visualizations, price comparison algorithms, and the user interface) are owned by the Company and protected by copyright, trademark, and other intellectual property laws. Ticket listing data is sourced from third-party platforms and remains the property of those platforms.
The Service contains links to third-party ticket marketplaces and other websites. We are not responsible for the content, privacy policies, practices, or terms of any third-party website. Your interactions with third-party platforms (including purchases, refunds, cancellations, and disputes) are solely between you and that third party.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, PRICES, OR DATA DISPLAYED THROUGH THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100), AS THE SERVICE IS PROVIDED FREE OF CHARGE.
This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if the Company has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) your purchase of tickets through third-party platforms accessed via the Service.
TixTreasure is not responsible for event cancellations, postponements, venue changes, performer no-shows, or any other event-related issues. Refund and exchange policies are determined solely by the third-party marketplace where you purchased your tickets. Contact the ticket seller directly for any purchase-related issues.
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the Commonwealth of Massachusetts. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
You may opt out of this arbitration provision by sending written notice to [email protected] within 30 days of first using the Service.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
We may terminate or suspend your access to the Service at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 10-15 survive termination.
